2. Assortment and prices

The pictures representing a product put on sale online are there to illustrate it closer to reality but are non-contractual. They are intended to show the drawing that will be printed and so there may be small differences with the actual product received.

3. Order

Once your payment has been received, the command is executed according to your specifications.
We reserve the right to delay delivery of any order if there is a dispute concerning payment of a previous order, until the time of payment. In special cases, we reserve the right to refuse orders without giving reasons.

4. Shipping

We will send you the goods by mail to all addresses in Switzerland, Europa, USA and Canada. More info in the Delivery page.

PLEASE CHECK THE ACCURACY OF YOUR POSTAL ADDRESS, any package delivered to the wrong address or returned to us because of unknown recipient will not be refunded

5. Term of payment

To order online, you have the option to pay in advance by bank transfer. Important note: when paying at post office counters, please consider the treatment costs and add 2 CHF total amount of your bill.

6. Retention of title

Apprentiphotographe remains the owner of the goods delivered until full payment of the amount due.

7. Warranty and liability

Apprentiphotographe guarantees the customer that his order will be executed according to the rules of art and with due diligence.
We are not responsible for the loss or deterioration of digital photos sent by Internet, wireless data transmission (WAP / mobile phone, etc.), CD-ROM or other storage medium. Any claim as reimbursement of the costs of hardware, data media costs, the costs necessary to achieve the photographs or frustration damage due to the loss of memory, etc. is excluded. We recommend our customers to back up data (backup) before you send them.

8. Computer Software 

Apprentiphotographe.ch resp. its suppliers own the entire contents of www.apprentiphotographe.ch website.

The customer is only allowed to download to their computer or mobile phone, palm, etc. software necessary for the execution of the order. Any commercial or non-commercial use is prohibited. It is also forbidden to download all or part of uncharacteristic of the website content without the express permission of Apprentiphotographe. Some logos, company, etc. www.apprentiphotographe.ch that appear on the website are legally protected.

9. Rights of third parties

The customer certifies that the holder of the copyright, trademark and all other rights to the photographs submitted and ensures that they do not violate the rights of others. The customer is in all cases solely responsible and fully assumes all costs of any potential third-party claims against Apprentiphotographe for the works required and is committed to meeting the damage so sustained by Apprentiphotographe.

10. Data Privacy, Confidentiality of data

We collect and process data using automated data processing equipment in accordance with the applicable Federal Data Protection Act (DPA).
The personal data of the customer are used exclusively for the purpose of guaranteeing him the quality treatment of his order as well as for the improvement of our offer and our services. The data are treated confidentially and are only passed on to third parties for the sole purpose of processing the order. When these data are transmitted to third parties for processing in Switzerland or abroad, their confidentiality remains guaranteed.

Since 25 May 2018, the GDPR (General Regulation of the European Union on Data Protection) has been applied as follows:

• The user has the possibility to ask to delete all his information in order to preserve his confidentiality by sending a copy of the email of his last order to shop@apprentiphotographe.ch with the mention "Please erase my data according to the GDPR"
• The security of the data transfer is assured according to the HTTPS protocol
• The payment agencies used on this site (Paypal / Postfinance) apply the standards of the GDPR
• The host of this site (Infomaniak.ch) is compatible and approved according to the standards of the GDPR

The data of the photographs and other photographic products, saved for the elaboration of the products, are automatically erased 3 months after the execution of the order.

11. Right of withdrawal

All our products are printed on request and after payment, according to the Buyer's specifications (type of garment, color, size, designs, etc.). In accordance with DIRECTIVE 2011/83/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of October 25, 2011 on consumer rights, the right of withdrawal does not apply, in accordance with the provisions of Article 16, paragraph c).
The Buyer will therefore not be granted a withdrawal period.

12. Applicable law, place of jurisdiction

This legal relationship is subject to Swiss law. The jurisdiction is Estavayer-Le-Lac, Switzerland.
